AGREEMENT BETWEEN THE VILLAGE OF ILION
and
MARIJO THOMPSON, TREASURER
2016 - 2018
This Employment Agreement ("Agreement") is made by and between the Village of Ilion, a New York municipality, ("Village") and MariJo Thompson, ("Treasurer"). Both parties agree to accept the conditions of employment described herein.
MariJo is currently employed by the Village as an Account Clerk and was appointed to serve as Treasurer. She desires to retain that position. In the event the Village elects not to reappoint MariJo as Treasurer, she shall continue in her Civil Service title of Account Clerk with any necessary Union approval and applicable collective bargaining agreement then in force.
SECTION 1. EMPLOYMENT/DUTIES
The Village wishes to employ MariJo Thompson as Treasurer, and MariJo agrees to accept the conditions of employment described in this agreement. MariJo shall serve in this capacity at the sole discretion and pleasure of the Village, pursuant to New York State Civil Service Law, and shall perform any other duties the Village Board deems necessary. The Treasurer shall have supervisory and confidential managerial responsibilities and duties associated with this position.
As a salaried employee, the Treasurer shall work a minimum of 2,080 hours per year with a one (1) hour paid lunch period minus any benefit time she receives during the calendar year.
The Treasurer shall record all days worked, vacation days, personal days, sick days, and compensatory time; and supply this record monthly to the Mayor.
SECTION 2. DISCIPLINE AND DISCHARGE
As an Account Clerk, MariJo is subject to discipline and discharge procedures pursuant to Section 75 of NYS Civil Service Law.
SECTION 3. SICK LEAVE
MJ may accumulate one and one half (1 h) days of sick leave per month. Sick leave may be accumulated up to 175 days.
If MariJo has maxed out her sick leave, she will be able to cash in unused sick days to a maximum often (10) days per calendar year. Payout will be made in the first pay period of the following June at the current rate of pay in effect that June.

Sick leave shall be used for necessary medical and dental appointments, including those necessitated by compensable injuries as defined under the Worker's Compensation Law of New York State if MariJo is on active status at the time of such necessary medical or dental appointments.
If ill, MariJo shall notify the Village prior to beginning her workday.
In the event there is a question about an illness or injury, the Village may require a doctor's certificate and/or request MariJo to be examined by a Village doctor. For a prolonged illness or injury, she must furnish a doctor's certificate every thirty (30) days if requested by the Village. The Village may make an independent investigation to establish whether MariJo is too ill to perform the duties of her employment.
If MariJo is absent on account of illness or injury for three (3) consecutive days or more, she will be required to furnish the Village with a doctor's certificate for proof of illness or injury. After any five (5) non-consecutive days in a calendar month, a doctor's certificate as proof of illness or injury must be fumished to the Village.
Abuse of sick leave will be grounds for disciplinary action.
Upon retirement or death, MariJo or her estate or beneficiary shall be paid for accumulated unused sick leave at the employee's daily rate of pay up to 175 days maximum. This may be taken as a lump sum over an agreed upon payment/settlement with the Village Board or put towards health insurance premiums. These are to be paid at a one (1) day for one (1) day basis.
SECTION 4. PERSONAL LEAVE
MariJo is entitled to five (5) personal leave days per calendar year. These days are noncumulative and will not be reimbursed if unused. Upon retirement, however, payment will be made for any unused personal leave days remaining in that year.
SECTION 5. BEREAVEMENT LEAVE
Absence from duty because of the death of a member of MariJo's immediate family will be allowed, without loss of compensation, as follows:
A. An immediate family member is defined as a spouse, child, mother, father, sister, brother, gandchild, grandparent, mother-in-law, father-in-law, brother and sisterin-law, stepmother, stepfather, or anyone living in her home.
B. Absence from duty for any reason stated in this section will be granted for a maximum of four (4) calendar days per incident, one (1) day being the date of the funeral.
C. If MariJo must travel out of state, she may, at the Village Board's discretion, be granted up to an additional three (3) calendar days of leave if the decedent is related as defined in Section 6 A.
D. Such bereavement leave is above and beyond sick and/or personal time.
E. In the event of the death of an aunt, uncle, niece or nephew, MariJo may use one (l) of her allotted bereavement days for the day of the funeral.

F. The Village Board may allow exceptions to the aforementioned bereavement leave policy.
SECTION 6. HOLIDAYS
MariJo shall receive the following thirteen (13) paid holidays:
New Year's Day, Martin Luther King Day, President's Day, Good Friday,
Memorial Day, Independence Day, Labor Day, Columbus Day, Veteran's Day,
Thanksgiving Day, Thanksgiving Friday, Christmas Eve Day, and Christmas Day.
If a holiday falls on a Saturday, the preceding Friday shall be considered as the holiday; if the holiday falls on a Sunday, the following Monday shall be considered as the holiday. If it is a mid-week holiday, it may be allowed to "float" with mutual consent of MJ and the Village.
SECTION 7. VACATION
With MariJo's hire date of October 8, 1999, she is eligible for five (5) weeks' vacation per year that is non-cumulative. Unused vacation time in a current year will be reimbursed for a maximum of two (2) weeks, with payment made in a separate check at her discretion.
After twenty (20) years of service MariJo will be eligible for six (6) weeks of vacation per year. A maximum of three (3) weeks of unused vacation will be reimbursed in a separate check at her discretion.
Upon retirement or death, MariJo or her estate or beneficiary will be compensated for any unused vacation time. This payment shall be made as soon as possible, based upon the Village's ability to pay.
SECTION 8. JURY DUTY
Should MariJo be called to serve for jury duty, as certified by the Court Clerk, she shall receive her normal pay but shall remit any and all compensation received from the Courts to the Treasurer immediately upon receipt.
SECTION 9. HEALTH CARE BENEFITS
Mari Jo is eligible to participate in the Village health benefit plan offered by the New York State Teamsters Council Health and Hospital Fund under the scheduled conditions and rates of contribution with the Select Plan and will be responsible to contribute to her insurance premiums at a rate of 12 % for 2016, 2017, and 2018. These are based on the coverage she chooses, i.e. single, two-person, or family.
The Village will reimburse MariJo for out-of-pocket medical expenses during the year with original receipts. Over-the-counter medications are not covered by this section unless prescribed by a physician. The following maximum reimbursement schedule will be followed and is based on MariJo having family coverage:

Although an employee's coverage may change at any time during the year, the reimbursement amount that she is eligible for on January 1 of the year the change occurs will remain in effect for the rest of that year.
MariJo's bi-weekly contribution to health insurance premiums is not eligible for reimbursement.
Upon retirement, MariJo shall be granted the same health insurance coverage as retirees pursuant to the Village's collective bargaining agreement with the Teamsters Union, Local #182 for the Water Department employees. Health insurance coverage shall be fully paid by the Employer if she meets the following criteria:
• Be sixty (60) years of age AND
• Have twenty five (25) years of employment with the Village.
Coverage will continue to age sixty five (65) or until Medicare is available to the retiree. Thereafter, the Employer will pay the full cost for insurance supplemental to Medicare that is provided by the insurance program in effect at the time of the employee's retirement. Employer will also pay thirty five percent (35%) of the cost for the spouse's supplemental insurance coverage if the retiree desires such coverage.
SECTION 10. SALARY
Effective January 1 1, 2016, the Treasurer's base salary shall be $50,000.
Effective January 1, 2017, the base salary will increase by 2% to $51,000. Effective January 1, 2018, the base salary will increase by 2% to $52,020.
This is payable in accordance with the Village's standard payroll procedures.
SECTION 11. LONGEVITY
Per agreement with the Village, MariJo will continue to be eligible for Longevity benefits as defined by the Tearnsters Water Department Contract schedule. Longevity pay will be paid to MariJo on her employment anniversary date.
SECTION 12. EDUCATION
The Village shall reimburse MariJo for college tuition upon completion of a course relating to her job classification based on the final grade in that class as follows:

SECTION 13. DURATION OF AGREEMENT.
This Agreement shall take effect January 1 1, 2016, and continue in full force up to December 31, 2018.
