VILLAGE OF ILION
AGREEMENT FOR THE FIRE CHIEF
2017-2018
This Employment Agreement ("Agreement") is made by and between the Village of Ilion, a New York municipality ("Village") and Robert C. Paddock ("Chief').
The following are the details of the employment:
SECTION 1. EMPLOYMENT DUTIES
The Village agrees to employ the Chief and the Chief agrees to accept the employment described in this Agreement. The Chief shall serve as the Fire Chief, Building and Fire Safety Codes Enforcement Officer, and Emergency Management Officer and any other duties the Village
Board deems necessary at the sole discretion and pleasure of the Village pursuant to New York State Civil Service Law with supervisory and confidential managerial responsibilities and duties associated with these positions.
Unless otherwise scheduled by the Village the Chief shall schedule his hours of work to optimize Village services.
As a salaried employee, the Chief shall work a minimum of 2,080 hours per year minus his benefit time.
The Chief shall record all his days worked, vacation days, personal days, sick days and compensatory time and supply this monthly to the Village Treasurer.
SECTION 2. DISCIPLINE AND DISCHARGE
The Chief is subject to discipline and discharge pursuant to Section 75 of NYS Civil Service Law.

SECTION 3. SICK LEAVE
A. Accumulation — The Chief shall be eligible for one (1) day of sick leave per month. Sick leave will accumulate to a maximum of one hundred seventy five (175) days.
B. Additional Accumulation — The Chief shall be allowed to have a second accumulation bank that will allow a maximum of one hundred forty five (145) days as a secondary bank to be used for a catastrophic illness or injury and will NOT be reimbursed upon the Chiefs retirement or death.
C. Payment of Accumulations —In the event of the Chief's retirement or death, the Chief or his heirs shall be awarded an amount equal to the Chief's accumulated sick leave, computed at his outgoing straight rate of pay. The Chief may elect to use the monies due at retirement to extend health care at a dollar for dollar exchange.
D. Family Sick Leave — The Chief may take up to fifteen (15) sick days of accumulated sick leave per year for family illness.
SECTION 4. PERSONAL LEAVE
The Chief is entitled to five (5) personal leave days per year and these days are non-cumulative and will not be reimbursed if unused in a calendar year. The only reimbursement for unused personal leave days would occur upon retirement and would only include the current year's time.
SECTION 5. VACATION
With the Chiefs hire date of July 5, 1993 and with 24+ years of service with the Ilion Fire Department, he is eligible for five (5) weeks of vacation per year that is non-cumulative.
The Chief may cash in a maximum of three (3) weeks of vacation at his request and shall be paid in a separate check upon request.

SECTION 6. BEREAVEMENT LEAVE
Absence from duty by the Chief by reason of a death of a member of his immediate family will be allowed, without loss of compensation as follows:
A. A family member is defined as a spouse, child, mother, father, sister, brother, grandchild, grandparent, mother-in-law and father-in-law. Absence from duty for any reason stated in this section will be granted for a maximum of four (4) calendar days per incident, one (1) day being the date of the funeral.
B. If the Chief must travel out of state, he shall, at the Village Board's discretion, be granted up to an additional three (3) calendar days of leave if the decedent is related as defined in Section 6. A.
C. Such bereavement leave is above and beyond sick and/or personal time.
D. In the event of the death of an Aunt, Uncle, Niece or Nephew, the Chief may use one (1) day of bereavement leave which shall be the day of the funeral.
E. The Village Board may rule any exceptions to the aforementioned bereavement leave
.
SECTION 7. HOLIDAYS
The Chief shall receive the following paid holidays:
New Year's Day, Martin Luther King Day, President's Day, Good Friday, Memorial Day, Independence Day, Labor Day, Columbus Day, Veteran's Day, Thanksgiving Day, Thanksgiving Friday, Christmas Eve, Christmas Day.
If any holiday falls on a Saturday, the previous Friday shall be considered as the holiday and if the holiday falls on a Sunday, the following Monday shall be considered as the holiday. The Chief does have the option of floating his holidays.
SECTION 8. JURY DUTY
Should the Chief be called to jury duty, as certified by the Court Clerk, he shall be paid by the Village at his regular daily rate. Any compensation he is due from the Court shall be turned in to the Village Treasurer immediately upon receipt.
SECTION 9. HEALTH CARE BENEFITS
The Chief is eligible to participate in the village health benefit plan. The Chief will be responsible to contribute to his health insurance premiums at a rate of 12% for the duration of this agreement.
SECTION 10. CLOTHING/UNIFORM ALLOWANCE
The Chief is eligible to receive the same allowance as the members of the Ilion Fire Department, per their collective bargaining agreement, to cover the purchase of uniforms, protective equipment, etc.
SECTION 11. VEHICLE
The Chief shall be able to take the fire department Chief's vehicle home if he so desires. This is so he may respond to emergency calls from his residence in the village 24 hours a day at a moments' notice. This vehicle is NOT to be used for personal business, but department and village business only.
SECTION 12. SALARY
Per this agreement the Chief's salary effective August 1, 2017 is as follows:
Total Annual Compensation $65,000.00
The Chief receives no longevity.
AGREEMENT COMMENCES AUGUST 1, 2017 AND EXPIRES ON JULY 31, 2018.
IN WITNESS WHEREOF, the Village Board has caused this instrument to be executed by its duly authorized officers and its corporate seal affixed along with the Fire Chief's signature on this day of2017.
