AGREEMENT FOR THE DPW SUPERVISOR

2015-2017


This Employment Agreement ("Agreement") is made by and between the Village of Ilion, a New York municipality, ("Village") and Jack Sterling ("Supervisor").

The Supervisor is currently employed by the Village as the DPW Supervisor and desires to retain that position.


SECTION 1. EMPLOYMENT DUTIES

The Village wishes to continue to employ Jack as Supervisor, and Jack agrees to accept the conditions of employment described in this agreement. Jack shall serve in this capacity at the sole discretion and pleasure of the Village, pursuant to New York State Civil Service Law, and shall perform any other duties the Village Board deems necessary. The Supervisor shall have supervisory and confidential managerial responsibilities and duties associated with this position.

As a salaried employee, the Supervisor shall work a minimum of 2,080 hours per year minus any benefit time he receives during the calendar year.

Unless otherwise specified by the Village, the Supervisor shall schedule his hours of work to optimize Village services.

The Supervisor shall record all days worked, vacation days, personal days, sick days and compensatory time and supply this monthly record to the Treasurer.


SECTION 2. DISCIPLINE AND DISCHARGE

The Supervisor is subject to discipline and discharge pursuant to Section 75 of NYS Civil Service Law.


SECTION 3. SICK LEAVE

A. The Supervisor shall be eligible for one (1) day of sick leave per month. Sick leave will accumulate to a maximum of one hundred forty-five (145) days.

B. The Supervisor shall be allowed to have a secondary bank with a maximum of one hundred forty-five (145) days to be used for a catastrophic illness or injury. Days in this bank will NOT be reimbursed upon the Supervisor's retirement or death.

C. The Supervisor may take up to fifteen (15) sick days of accumulated sick leave per year for family illness.

D. Upon retirement or in the event of the Supervisor's death, the Supervisor or his heirs shall be awarded an amount equal to the Supervisor's accumulated sick leave, computed at his outgoing base salary rate of pay.


SECTION 4. PERSONAL LEAVE

The Supervisor is entitled to five (5) personal leave days per year. These days are noncumulative and will not be reimbursed if unused in a calendar year. Upon retirement, however, reimbursement will occur for any unused personal leave days remaining in that year.

In the event of the Supervisor's death during his employment, his heirs shall be awarded an amount equal to the unused personal days for the calendar year.


SECTION 5. VACATION

With the Supervisor's hire date of June 3, 2002, he is eligible for four (4) weeks of vacation per year that is non-cumulative. Unused vacation time in a current year will be reimbursed for a maximum of two (2) weeks, with payment made in a separate check at the discretion of the Supervisor.


SECTION 6. BEREAVEMENT LEAVE

Absence from duty by the Supervisor because of a death of a member of his immediate family will be allowed, without loss of compensation, as follows:

A. An immediate family member is defined as a spouse, child, mother, father, sister, brother, grandchild, grandparent, mother-in-law and father-in-law.

B. Absence from duty for any reason stated in this section will be granted for a maximum of four (4) calendar days per incident, one (1) day being the date of the funeral.

C. If the Supervisor must travel out of state, he may, at the Village Board's discretion, be granted up to an additional three (3) calendar days of leave if the decedent is related as defined in Section 6 A.

D. Such bereavement leave is above and beyond sick and/or personal time.

E. In the event of the death of an aunt, uncle, niece or nephew, the Supervisor may use one (1) of his allotted bereavement days for the day of the funeral.

F. The Village Board may allow exceptions to the aforementioned bereavement leave policy.


SECTION 7. HOLIDAYS

The Supervisor shall receive the following thirteen (13) paid holidays:

New Year's Day, Martin Luther King Day, President's Day, Good Friday, Memorial Day, Independence Day, Labor Day, Columbus Day, Veteran's Day, Thanksgiving Day, Thanksgiving Friday, Christmas Eve, and Christmas Day.

If a holiday falls on a Saturday, the preceding Friday shall be considered as the holiday; if the holiday falls on a Sunday, the following Monday shall be considered as the holiday

SECTION 8. CLOTHING/BOOT ALLOWANCE

The DPW Supervisor will receive a clothing/boot allowance of $475 each fiscal year. A separate check for the clothing and boot allowance, with FICA and Medicare taxes taken out, will be issued on the second pay period in July.

This allowance is to be used for the purpose of any items worn or used exclusively by the Supervisor while at work for the Village of Ilion. Receipts for these purchases will not be required.


SECTION 9. HEALTH CARE BENEFITS

The Supervisor is eligible to participate in the Village health benefit plan. The

Supervisor will be responsible to contribute to his insurance premiums at a rate of 12% for the term of this Agreement.


SECTION 10. SALARY

Effective January 1, 2015, the Supervisor's salary is as follows:

Base salary $51,833.45

There will be a 2% increase to the base salary on 1/1/2016 and a 2% increase on 1/1/2017. A retroactive payment from 1/1/15 to the date upon which this Agreement is signed, minus applicable taxes, will be made to the Supervisor.

Anyone hired to the Supervisor's position after 1/1/2011 will not receive longevity.

SECTION 12. JURY DUTY

Should the Supervisor be called to serve for jury duty as certified by the Court Clerk, he shall receive his normal pay but shall remit any and all compensation received from the Courts to the Treasurer immediately upon receipt.

THIS AGREEMENT COMMENCES JANUARY 1, 2015 AND EXPIRES ON DECEMBER 31, 2017.

IN WITNESS WHEREOF, the Village Board has caused this instrument to be executed by its duly authorized officers and its corporate seal affixed along with the Supervisor's signature on this day of2016.
